Cobra Air – Delivery Terms & Conditions

1. Third-Party Delivery Service

All Cobra Air compressors, systems and associated equipment are delivered using independent third-party pallet delivery and haulage providers.

Cobra Air does not operate its own delivery fleet. Once goods have been collected from us, their transportation, routing and delivery are undertaken by the appointed third-party carrier.

We will always make reasonable efforts to ensure your order is dispatched correctly and on time and will assist with tracking or resolving any delivery issues where necessary.

2. Delivery Dates & Timeframes

Any delivery date, estimated delivery date or delivery timeframe provided by Cobra Air is given in good faith but is an estimate only and is not guaranteed.

Pallet deliveries operate through a shared pallet network. Although deliveries will normally take place within the estimated timeframe provided, delays can occasionally occur.

Delays may arise due to circumstances outside Cobra Air’s reasonable control, including but not limited to:

  • Traffic or road closures
  • Adverse weather conditions
  • Vehicle breakdowns
  • Depot delays
  • Staffing issues
  • Pallet network disruption
  • Incorrect or incomplete delivery information
  • Restricted access to the delivery address
  • Other operational issues affecting the third-party carrier

Cobra Air cannot guarantee that an order will arrive on a particular date or at a particular time.

3. Arranging Work Around Your Delivery

Customers should not arrange engineers, employees, subcontractors, installation work, equipment hire, customer bookings or other work that is dependent upon the compressor arriving on a particular date until the equipment has been received.

For business customers, Cobra Air will not be responsible for loss of profit, loss of revenue, loss of business, loss of opportunity, cancelled work, labour costs, staff costs, equipment hire, downtime or other indirect or consequential losses resulting from a delivery delay outside our reasonable control, to the fullest extent permitted by law.

4. Delivery Delays

If we become aware of a delay, we will make reasonable efforts to obtain information from the delivery provider and keep the customer informed.

As delivery is undertaken by an independent third-party carrier, Cobra Air cannot control or prevent delays occurring within the pallet network.

A delay to an estimated delivery date does not automatically entitle a business customer to compensation for losses or costs incurred as a result of that delay.

Nothing within these terms affects any statutory rights or remedies which cannot legally be excluded or restricted.

5. Delivery Address & Access

It is the customer’s responsibility to provide a complete and accurate delivery address, together with any information reasonably required to complete the delivery.

The customer must ensure that the delivery location is suitable and accessible for the type of vehicle required to deliver palletised equipment.

Where applicable, someone must be available at the delivery address to accept the goods.

If a delivery cannot be completed because of incorrect information, unsuitable or restricted access, nobody being available to accept the delivery, refusal of delivery or another circumstance attributable to the customer, any additional delivery, storage or redelivery charges incurred may be passed on to the customer.

6. Checking Your Delivery

Customers should inspect the pallet, packaging and equipment upon delivery wherever reasonably possible.

If there is any visible damage to the pallet, packaging or equipment, this should be noted with the delivery driver and reported to Cobra Air as soon as possible.

We strongly recommend taking photographs of any visible damage before unpacking the equipment.

Please retain all packaging until any reported issue has been investigated, as photographs and/or packaging may be required when dealing with the delivery provider.

7. Damage or Missing Items

If your compressor or associated equipment arrives damaged, or any items appear to be missing, please contact Cobra Air as soon as possible with details of the issue and photographs where appropriate.

We will investigate the matter and liaise with the delivery provider where necessary.

8. Failed Deliveries & Additional Charges

All delivery dates and timeframes provided by Cobra Air or the third-party carrier are estimates only and are not guaranteed. Customers should be aware that the actual delivery attempt may take place on a different day from the date or timeframe originally advised.

Customers are responsible for making suitable arrangements to accept delivery when the carrier attends the delivery address. This responsibility still applies where the carrier attempts delivery on a different day from the date previously estimated or advised.

If the carrier is unable to complete delivery because nobody is available to accept the goods, access cannot be provided, suitable unloading arrangements are unavailable, the delivery is refused, or for another reason attributable to the customer, the delivery may be classed as a failed delivery and an additional charge will apply.

A failed delivery charge may therefore apply even where the attempted delivery takes place on a different day from the delivery date originally estimated or advised by Cobra Air or the carrier.

Where a further delivery attempt is required, additional redelivery, storage or other carrier charges may also apply. Any reasonable additional charges incurred by Cobra Air as a result of the failed delivery may be passed on to the customer.

Cobra Air reserves the right to require payment of any additional charges before redelivery is arranged.

9. Events Outside Our Reasonable Control

Cobra Air will not be responsible for a delay caused by events outside our reasonable control.

These may include, but are not limited to, severe weather, flooding, road closures, accidents, vehicle breakdowns, industrial action, transport network disruption, depot disruption, national emergencies or other events which prevent or delay the third-party carrier from completing the delivery as expected.

10. Consumer Rights

Nothing contained within these Delivery Terms & Conditions is intended to exclude, restrict or limit any rights or remedies that a customer has under applicable UK law which cannot legally be excluded or restricted.

Where the customer is purchasing the equipment wholly or mainly for business purposes, the provisions within these terms relating to business losses and consequential losses will apply to the fullest extent permitted by law.
